radios to disseminate what is working for the Campaign against 'black', and precarious labor precariousness in ARBA
14 bis. For the governor and the mayor do as Don Carlos.
What is 14 bis?
Article 14 bis is a provision of the Constitution which reads as follows: dignified and equitable conditions of work, rest and paid vacation, pay fair, living wage mobile, equal pay for equal work, protection against arbitrary dismissal ; stability of public employment, free and democratic trade union organization; conclude collective bargaining agreements, recourse to conciliation and arbitration, the right to strike; compulsory social insurance, pension contributions, the full protection of the family, among others . These rights are included, explicitly and with such designations, in Article 14 bis of the Constitution still in force ( http://www.senado.gov.ar/web/interes/constitucion/capitulo1.php ).
Given the evidence that the State itself (municipal, provincial, national) violate these rights in a top law, workers of various government departments, contracted in various ways-some permanent staff, other precarious, are joining forces to promote a campaign against precarious work.
Who is Don Carlos?
Don Carlos is a character in a state propaganda, after having their employees 'black' for years, do the math and decided to blanch, passing the agreement that legally belongs.
is very contradictory, even cynical, that the same precarious state that promotes work-over garbage contracts of various kinds, and even outsourcing services, advertise talking about "the fight against black work".
therefore requires the state, our employers, to do as Don Carlos and move to plant employees, ending a good time with precarious employment. How
What is the campaign?
Campaign Against work 'black', and precarious labor conditions is to require that State agencies implement and enforce labor laws, which in the case of State of the Province of Buenos Aires, so far, is public employment law, No. 10,430.
In this case it's an initiative that we will submit to the executive, the judiciary and the heads of all parliamentary blocs, to see if it is so that everyone is working against black, "to be considered the need to pass the precarious ground. The presentation contains only 2 points:
1. Go to all hired plant precariously.
2. Recognition of seniority for all employees for the period of employment relationship is not recognized as such. For this initiative
not throw down the toilet at 5 minutes, we encourage awareness of the general population and the state in particular through the wider dissemination of existing labor rights and signing a request to support the presentation.
Who are advancing this campaign? Who do we want to join?
So far, we are participating workers in various departments of provincial and municipal status. Surely we have differences on a lot of topics, but we can agree on this point and shoot for the same side.
fueled this campaign from the capital of the province of Buenos Aires, in a spirit that extends to all levels of the state and across the country. We know that in other places such as Rosario, Buenos Aires and many other places there are struggles against precariousness. We also know that in our own region, there are many other colleagues who share this struggle, and we are committed to join forces and unite together. The call is open to participate, individually or collectively if you're organized / a in a group, body of delegates or any instances of union organization that shares the goal of terminar con estas situaciones de injusticia.
2º) Representaciones sindicales
3º) Agrupaciones de trabajadores/as
4º) Otras organizaciones
Y dentro each, are ordered by date of "arrival" of membership.
In response to your mail, in addition to merge all signatures, we will send a request to be able to gather signatures, we can arrange to have posters, flyers, stickers and other materials or you can download directly from the website www.14bisDonCarlos.blogspot.com.
If you belong to an association, union, space, etc.. You can use these materials and add your signature, work with your colleagues from your collective identity. Or you can create your own materials, your beauty and your shades: the idea is not to artificially declare differences or to enforce uniformity of anything but simply to agree on one important point-the end of work "black" - and join forces in the same direction. Therefore all actions are "allowed" and encouraged. The only point of agreement is to work the same request and, if possible, think of a large stock of mobilization to submit the signatures.
What is the commitment if I join the Campaign?
In principle, agree with these points and make a little effort, you can-for dissemination.
Collect signatures if they can: not in your workplace if you will be subject to persecution (the idea is not exposed unnecessarily), but in your neighborhood, among your friends, etc.
In short, you feel part and do what you feel you can do to add strength to the initiative.
What risks do I if I join the campaign?
According to the laws that protect workers, no one should take risks to defend their rights. The employer is the one at fault, not the employee is organized by the dignity of labor. But we know that many times a thing is what the law says and what other managers do comply, that nobody tried to run any risk. For that reason we publicized the names of classmates without trade union, we try to coordinate activities without the leadership as having the partners in the most precarious situation and mobilization activities, taking an idea and worked in other places, promote the use of masks (to Saint Precarious, play mobile, etc.). not to expose anyone's identity.
The proposal is to disseminate knowledge and we are not alone, build unity and take care of each / as.
What I can win if I join the campaign?
First, from the individual level, participate to defend your rights is above all an act of dignity. Without exposing the taste, all / as we do something, however little it is, that contribution to building social force that at some point there is no more precarious employment.
Collectively, that something which is coupled with others can help many struggles, distorting the idea that it is "normal" precarious work, reconsidering the union of workers and aiming to regain rights that cost years of class struggle working and that the fragmentation that exists today are violated even by the State. At a minimum, we want to make clear the working situations of injustice that exist, know and recognize as workers try to reverse the idea of \u200b\u200bspreading "natural" existence. Also, rescue organization processes and fights that occur in many places but not known, and often end with significant gains.
We believe this battle of ideas can promote fights that are occurring in several places and many others that still exist because there is a great disunity of workers, resulting in a major weakness. If we can all come together, sooner or later we will make the precarious double standard is untenable, and thus advance to have a job with more dignity and better conditions for everyone.
And the unions? Are they invited?
Of course, the idea is to join all the union representatives who share this objective. In fact, many of us participated in unions (ATE, for example) and struggle to improve conditions in our workplaces. Unions are
historic building has been the working class to unite and fight for their rights. In recent times, many have been corrupted and have practices that speak more to the employers that workers base, but all in all still-still-having representations that try-try-build another unionism. The bet goes through to assemble the union organizing practices along with many other colleagues who do not have the ability to organize, for the same precarious situation they are in their workplaces. Understanding the heterogeneity in the class found is a circumstance that should not make us abandon the goal of achieving higher levels of unity, organization and collective strength. The fragmentation
we all lose. In the call to unite, despite our different situations, even despite our different perceptions of the situation is the possibility of recovering their rights as working people have won in history to not give up. So we have to continue building it. The invitation to you consume you from the place it is, is made.
Sumate! The call is completely open.
